The protection of personal data is important to us, the Laurenz Herting Foundation, Seevenweg 61, 21266 Jesteburg, Germany (hereinafter "Laurenz Herting Foundation" or "we"). We only process your personal data in accordance with the statutory provisions, in particular Regulation (EU) 2016/679 (General Data Protection Regulation, hereinafter "GDPR") and the German Federal Data Protection Act (hereinafter "BDSG").

Furthermore, this privacy policy informs you about the protection of your privacy on the terminal equipment you use within the meaning of Section 25 of the Act on Data Protection and Privacy in Telecommunications and Digital Services (hereinafter referred to as "TDDDG").

3. data processing for general use of our website

When you visit our website, your Internet browser automatically sends Internet connection data and certain telemedia and usage data stored in the Internet browser of your end device to our servers, which we process.

3.3 Revocation of your consent

You can revoke your consent given in the cookie consent banner at any time for the future (Art. 7 para. 3 GDPR). To do so, click on the "Change consent" button in the cookie consent banner on our website. You can access the cookie consent banner by clicking on the icon at the bottom left of the website.

3.4 Borlabs Cookie

In order to obtain your consent or refusal to the storage of certain cookies in your browser and to document this in accordance with data protection regulations, we use Borlabs Cookie (hereinafter referred to as "Borlabs") consent technology on our website. The provider of this technology is Borlabs GmbH, Rübenkamp 32, 22305 Hamburg, Germany. When you visit our website, a Borlabs cookie is stored in your browser, in which the consent you have given or your refusal is stored. This data will not be passed on to Borlabs GmbH. 3.5 Web analysis with Google Analytics

We use the web analysis service Google Analytics to collect, collate and evaluate data about your behavior on our website. Among other things, this collects data about which website you came to our website from, which subpages you accessed or how often and for how long you viewed a subpage. The data collected by Google Analytics is also stored on Google servers in the USA. We have activated the IP anonymization function on our websites. This means that your IP address is truncated by Google within member states of the EU or the EEA before being transmitted to the USA. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and truncated there. The IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data. In its adequacy decision of July 10, 2023, the EU Commission determined that the level of data protection in the USA is comparable to that in the EU. Google LLC is certified under the EU-US Data Privacy Framework on which the EU Commission's decision is based. The processing of personal data enables us to analyze the surfing behavior of visitors to our website. By evaluating the data obtained, we are able to compile and optimize information about the use of the individual areas and offers. The legal basis for the processing is your consent in accordance with Section 25 (1) TDDDG, Art. 6 (1) sentence 1 lit. a) GDPR, which you give when you access our website via the selection on our cookie banner.

3.6 Web hosting

We operate our website on servers of the service provider ALL-INKL.COM - Neue Medien Münnich, Inh. René Münnich, Hauptstraße 68, 02742 Friedersdorf (hereinafter referred to as "All-Inkl"). All-Inkl processes your data on our behalf, i.e. exclusively in accordance with our instructions. We have concluded a corresponding data processing agreement with All-Inkl in accordance with Art. 28 GDPR. 3.7 Ninja Firewall

We have integrated Ninja Firewall on this website. The provider is NinTechNet Limited, Unit 1603, 16th Floor, The L. Plaza 367 - 375 Queen's Road Central Sheung Wan, Hong Kong.

Ninja Firewall is used to protect our website from unwanted access or malicious cyberattacks. For this purpose, Ninja Firewall records the IP address, request, referrer and time of page access. Ninja Firewall is integrated on our own servers and does not transmit any personal data to the provider of the tool or other third parties. We have activated IP anonymization in Ninja Firewall so that the tool only records the IP address in abbreviated form.

The use of Ninja Firewall is based on Art. 6 para. 1 lit. f) GDPR. We have a legitimate interest in protecting our website as effectively as possible against cyberattacks.

3.8 Manage WP

We manage this website with the help of the ManageWP tool. The provider is GoDaddy.com WP Europe, Trg republike 5, 11000 Belgrade, Serbia. ManageWP allows us to monitor the security and performance of our website and create automatic backups, among other things. ManageWP therefore has access to all website content, including our databases. ManageWP is hosted on the provider's servers. The use of ManageWP is based on Art. 6 para. 1 lit. f) GDPR. We have a legitimate interest in the most effective and secure operation of our website. GoDaddy.com WP Europe is based in Serbia. The use of ManageWP therefore involves a transfer to a third country outside the European Union (hereinafter "EU") and the European Economic Area. We have therefore concluded an agreement with GoDaddy.com WP Europe on the standard contractual clauses of the EU Commission. Your personal data may be transferred within GoDaddy.com WP Europe to the parent organization GoDaddy Operating Company LLC, 1 00 S. Mill Ave Suite 1600 Tempe, AZ 85281 USA may be transferred. The European Commission has recognized the level of data protection for certain companies from the USA in an adequacy decision (so-called EU-U.S. Data Privacy Framework). GoDaddy Operating Company LLC has self-certified under this framework and is therefore committed to compliance. This self-certification means that the transfer of personal data to the USA is permitted on the basis of the EU-U.S. Data Privacy Framework. 4. donations

We offer you the opportunity to support us through donations. To make a donation, all you have to do is fill out and submit the donation form on our website.

As part of your donation, we collect and process your first and last name, your e-mail address, the donation amount you have chosen, the donation frequency and the payment method you have chosen as mandatory information.

The legal basis for this data processing is the initiation and fulfillment of the donation agreement concluded with you, Art. 6 para. 1 letter b GDPR.

When you contact us (e.g. by e-mail or telephone), we process the personal data required to respond to your inquiries. Depending on the type of contact you choose, this may include your e-mail address, telephone number, full name and any other personal data that you provide to us as part of your request. The legal basis for the processing of this personal data, insofar as the processing of your data serves the fulfillment of a contract or takes place in the context of the initiation of a contractual relationship, is Art. 6 para. 1 lit. b GDPR. In addition, we have a legitimate interest in processing your data, as otherwise we would not be able to process or answer your request (Art. 6 para. 1 lit. f GDPR).

6. your data protection rights

As a data subject of the data processing of our foundation, you are entitled to data protection rights under the respective legal requirements.

In accordance with Art. 7 para. 3 sentence 1 GDPR, you have the right to revoke consent that you have given for the processing of your data at any time with effect for the future without giving reasons.

You have the right to request information about the personal data we have stored about you in accordance with Art. 15 para. 1 GDPR.

In addition, you have the right to rectification (Art. 16 GDPR), erasure (Art. 17 GDPR) and restriction of processing (Art. 18 GDPR) with regard to your personal data.

For data processing that is based on our legitimate interests (Art. 6 para. 1 lit. f GDPR), you have the right to object in accordance with Art. 21 GDPR. If you object to data processing, this will not take place in the future unless we can demonstrate compelling legitimate grounds for further processing that override your interest in objecting.

If you have provided the processed data yourself, you have a right to data portability in accordance with Art. 20 GDPR.

You also have the right to lodge a complaint with a competent data protection supervisory authority.

7. criteria for determining the duration for which the personal data is stored

We delete your personal data as soon as its processing is no longer necessary for the purposes explained in this privacy policy, in the event of your objection pursuant to Art. 21 (1) GDPR, there are no compelling legitimate grounds of our company to prevent the deletion or, in the event of revocation of consent, there is no other legal basis for the processing.

In the case of the collection of data for the provision of the website, this is the case when the respective session has ended. If you support us with a donation, this is only the case after the regular limitation period of three years (§ 195 BGB) has expired. Statutory retention rights and obligations remain unaffected by this.

8. recipient of your data

Within our foundation, access to your personal data is only granted to those persons who need it to fulfill our legal obligations.

We also have individual internal foundation processes and services carried out by carefully selected and data protection-compliant service providers. These are companies, particularly in the field of IT services, which process your data in accordance with our instructions on the basis of order processing contracts pursuant to Art. 28 GDPR. We only disclose your data to other third parties if we are legally obliged to do so or if there is another legal basis for doing so.

We may transfer your personal data to recipients in countries outside the EU and the European Economic Area. If the level of data protection there does not correspond to the level of data protection within the EU or the recipient of the data does not fall within the scope of an adequacy decision of the EU Commission, we will ensure suitable guarantees within the meaning of Art. 46 GDPR. This may include the agreement of standard contractual clauses of the EU Commission and any additional measures required to ensure an adequate level of data protection. In individual cases, we make the transfer to third countries dependent on your consent to this data transfer in accordance with Art. 49 para. 1 sentence 1 lit. a GDPR.
